Approval of November 27, 2020 and December 4, 2020 minutes. 2. Consider extending City of Fremont Community Directed Health Measure #2. ADJOURNMENT The agenda was posted at the Municipal Building on January 22, 2021 and online at www.fremontne.gov. The agenda was distributed to the Mayor and the Board of Health on January 22, 2021. This meeting is preceded by publicized notice with the area news media. The official current copy of the agenda is available at City Hall, 400 East Military, City Administrator’s Office. The Board of Health reserves the right to go into Executive Session at any time. A copy of the Open Meeting Law is posted in the City Council Chambers for review by the public. §2-109 Audience / Participant; Rules of Conduct. The following rules are established for audience members and participants at a Council meeting: 1. At the discretion of the presiding officer, any person may address the Council, on any agenda item; however, questions to City officials or staff, other speakers, or members of the audience are not permitted and will not be answered. 2. Any person wishing to address the Council shall first state their name and address 3. Remarks shall be limited to five minutes unless extended or limited by the Presiding Officer or majority vote of the Council. 4. No person will be permitted to address the Council more than once during discussion of a particular agenda item. Rebuttal comments are not permitted. 5. Repetitive or cumulative remarks may be limited or excluded by the Presiding Officer or majority vote of the Council. 6. Profanity or raised voice is not permitted. 7. Applause, booing, or other indications of support or displeasure with a speaker are not permitted. 8. Any person violating these rules may be removed from the Council Chambers. The following additional rules are established and applicable for public participants at an Open Public Comment Period or Study Session meeting: 9. At the direction of the presiding officer, Open Public Comment Period Speaker Topics will be limited to those not covered by a published [PAGE 3] agenda for any Study Session, or any regular City Council meeting. 10. A priority to speak at Open Public Comment Periods and Study Session shall be given to those speakers who reside within the City limits, or within the ETJ (Extra-Territorial Jurisdiction – a two (2) mile radius of the City limits) of Fremont, and then, as time allows, to those who do not. 11. Member of the public wishing to speak at a Study Session will be required to limit their comments to those that are directly related to the Publicly Noticed Study Session agenda topic(s). 12. Written letters addressed to the City Council will be accepted, as will comment cards that will be made available and collected from those who attend Open Public Comment Period and Study Session meetings who do not wish to speak publicly, but have an issue or concern that they believe the Council should be made aware of. [PAGE 4] MINUTES from the EMERGENCY MEETING OF THE BOARD OF HEALTH November 27, 2020 - 8:00 AM. Fremont Municipal Building, 2nd Floor Conference Room 400 East Military, Fremont, Nebraska (attendance is limited) and Zoom ________________________________________________________________________ EMERGENCY MEETING MINUTES: 1. Meeting called to order – Open Meetings Law. The Emergency meeting of the Board of Health Board was called to order by the Mayor and it was stated that a copy of the open meeting law is posted continually for public inspection located near the entrance door by the agendas. 2. Roll call. Roll call showed Mayor Getzschman, Council President Jacobus, Doctor Seitz, and Chief Elliott present. Four members present. 3. Consider COVID-19 control measures, including mandates, directives, and enforcement actions. Council President Jacobus handed out a document and made a motion to have it received into the public record; Elliott seconded the motion. Ayes: Getzschman, Jacobus, Seitz, and Elliott. Motion carried 4-0. The board discussed the number of COVID-19 cases, hospitalizations, and deaths and debated the use of face coverings. City Administrator Newton passed out a draft Community Health Directive that required face coverings in premises open to the general public for the Board to consider. City Attorney Travis Jacott said the reference to City Code needed to be amended. Council President Jacobus made a motion to have the draft received into the public record; Seitz seconded the motion. Ayes: Getzschman, Jacobus, Seitz, and Elliott. Motion carried 4-0. Council President Jacobus made a motion to amend the Community Health Directive to strike the following sentence, “unless the person can maintain a minimum of six (6) feet of separation or social distance at all times from anyone who is not a member of the person’s household,” to change the effective date from December 1, 2020 to November 28, 2020, and to change the reference to Fremont Municipal Code from Chapter 6, Article 6, Section 6-501 to Section 4, Section 4-601; Seitz seconded the motion. Ayes: Getzschman, Jacobus, and Seitz. Nays: Elliott. Motion carried 3-1. Seitz made a motion to approve the amended Community Health Directive; Jacobus seconded the motion. Ayes: Getzschman, Jacobus, and Seitz. Nays: Elliott. Motion carried 3-1. The Board agreed to meet in one week (December 4, 2020) to see how the Community Health Directive was working and if they should consider recommending additional mandates or enforcement actions to City Council. 4. Meeting called to order – Open Meetings Law. The meeting of the Board of Health Board was called to order by Mayor Getzschman and it was stated that a copy of the open meeting law is posted continually for public inspection located near the entrance door by the agendas. 6. Roll call. Roll call showed Mayor Getzschman, Council President Jacobus, Doctor Seitz, and Chief Elliott present. Four members present. 7. Consider COVID-19 control measures, including mandates and enforcement actions. Mayor Getzschman asked members of the board to present their perspective of COVID-19 cases in Fremont and whether they felt the health directive was being observed. Dr. Seitz and the other members generally felt that COVID-19 cases had declined and that members of public were complying with the health directive to wear face coverings. Council President Jacobus offered a motion to continue the Community Health Directive on face coverings until January 31, 2021 and to revisit the directive as the Board deemed appropriate; Dr. Seitz seconded the motion. Ayes: Getzschman, Jacobus, and Seitz. Nays: Elliott. Motion carried 3-1. 8. Adjournment. Motion made by Jacobus; seconded by Dr. Seitz to adjourn at 8:16 AM.
