convene concurrently.

available the Thursday prior to the scheduled Tuesday meeting). Materials related to an item on
this agenda submitted to the City Council/Successor Agency after distribution of the agenda packet
are available for public inspection in the City Clerk’s Office during regular business hours and on
the City’s website subject to staff’s ability post the documents before the meeting.

Challenging City Council/Successor Agency Decisions: Any legal action by an applicant seeking
to obtain a judicial review of the City Council/Successor Agency’s decision on a hearing or issue
listed on this Agenda may be subject to the 90-day filing period of, and governed by, Code of Civil
Procedure § 1094.6. Additionally, if you challenge the actions of the City Council/Successor
Agency in court, you may be limited to raising only those issues you or someone else raised at the
public hearing described in the public notice, or in written correspondence delivered to the City
Council/Successor Agency at, or prior to, the public hearing pursuant to California Government
Code § 65009.
Consent Calendar: Items listed on the Consent Calendar are considered to be routine in nature,
not discussed individually, and are normally approved by one motion. If a Councilmember or
member of the public wishes to comment on a particular item, that item shall be removed for
separate action.
No New Business will be considered by the City Council/Successor Agency after 11:30 p.m.
unless a majority of the legislative body determines to continue.
Public Input: If you wish to address the Council/Successor Agency regarding an item listed on this
agenda, please complete and submit an Audience Participation Form to the City Clerk prior to
consideration of that agenda item. Public Comments is the time for presentations/comments not
on this agenda but within the subject-matter jurisdiction of the City Council/Successor Agency.

7. Old Business
A. Receive Report and Provide Direction on the Proposed Establishment of a Residential
Property Pre-Sale/Humane Living Standards Inspection Program
Recommendation:
It is recommended that the City Council:
1) Direct staff to prepare an ordinance to adopt the Pre-Sale/Humane Living
Standards Inspection program and create an amnesty program to waive
permit fees during the first year of the program. Staff recommends starting the
program January 1, 2016. All home sellers would need to complete a property
survey which will be made available on the city website. If the seller responds
yes to any questions the City will do an inspection and waive the permit fees.
After one year city staff will provide a report to the City Council on the number
of permits issued due to the program; or 2) City Council provide staff input on

the proposed process and direct staff, if desired, to move forward with the
establishment of a pre-sale/humane living standards inspection program
requiring a building records search. This would include the preparation of an
ordinance to add this program to the Fillmore Municipal Code and the
preparation of a resolution establishing a fee for the program. Input is
requested on the following items:
A - How long should an inspection report be valid?
B- Should violation of this section be an infraction, misdemeanor or a
wobbler (a misdemeanor that can be reduced to an infraction)?
C- Should the inspection program included only violations for garage
conversions and illegal room additions and subdivisions?
D- Should there be penalties to the program?
E- Should the inspection program be called – Humane Living Standards
Inspection?
3) Discuss and provide direction on whether the program should include an
inspection of rental properties. Staff does not recommend this option;
Alternatives:
4) Do not move forward with a pre-sale inspection program; or 5) Direct staff to
meet with local real estate brokers to obtain feedback and present those findings
to Council.
8. New Business
A. Consider authorizing the Mayor to Execute a New Franchise Agreement for Solid Waste
Handling Services between City of Fillmore and Santa Clara Valley Disposal.
Recommendation: 1) Authorize Mayor to execute a new franchise agreement for solid
waste handling service with Santa Clara Valley Disposal, in a form approved by the City
Attorney; or 2) Do not authorize Mayor to execute a new franchise agreement for solid
waste handling services with Santa Clara Valley Disposal; or 3) Provide additional
direction to staff.
B. Approve the Execution of a Contract with Granicus, Inc. to Perform Live Video Streaming
and Agenda Management Services for the City.
Recommendation: 1) Authorize the Mayor to execute a contract with Granicus Inc., in a
form approved by the City Attorney, to perform live video streaming and agenda
management services for a period not to exceed three years; or 2) Do not approve the
Contract with Granicus, Inc.; or 3) Provide other direction to staff.
C. Provide Direction and Receive Report on the Establishment of an Amphitheater.

Recommendation: 1) City Council provide staff input on the proposed site and design of
an amphitheater; A) Where should the amphitheater be located; B) Should staff compile
various designs for City Council to review and provide direction; or 2) Do not move
forward with an amphitheater; or 3) Direct staff to meet with local cities to discuss their
amphitheater usage and design.

A. CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION - The City Council
will conduct a closed session, pursuant to Government Code section 54956.9(d)(1), to
confer with legal counsel regarding litigation to which the City is a party. The title of such
litigation is as follows: City of Fillmore vs. Ramon M. Becerra and Trinidad C. Becerra et
al; Case Number CIV245419; County of Ventura – Oxnard Division Superior Court.
13. Adjournment: Mayor adjourns this meeting to the next City Council regular meeting
scheduled for October 13, 2015 at 6:30 p.m. at City Hall, 250 Central Avenue.
